A zoning bylaw amendment application to redevelop a legal non-conforming cottage property on Acton Island (Tozser on Innisfree Road) was made to the Township of Muskoka Lakes and the statutory public meeting was held August 12, 2021. A total of 5 significant exemptions from the existing zoning by-law were requested. The MLA, along with the local cottage association (Acton Island Association) and numerous nearby property owners, were concerned with the potential environmental and social impacts of approval and the precedent it might set.
Following the Public Meeting, Township Planning Committee requested several modifications to the application. The application came back to Township Planning Committee on November 11, 2021, with no material changes. Township Planning Committee denied the application.
The applicant appealed the Township’s decision to the Ontario Land Tribunal (formerly the OMB). A hearing date has not yet been set; however, Township Council voted on April 13, 2022, to oppose the appeal. The vote was recorded with only Mayor Harding in disagreement.
Following the In Camera portion of the October 12, 2022 Council meeting, Township staff and legal council were authorized by Council to execute Minutes of Settlement with the Tozsers. The terms of the proposed settlement are not yet public.
